Waiver - Terms & Conditions

TERMS & CONDITIONS, ASSUMPTION OF RISK, AND RELEASE OF LIABILITY

Different Breed Performance Training, LLC By booking, attending, entering, or participating in any program, training session, activity, or event with Different Breed Performance Training, LLC (Different Breed), you acknowledge that you have read, understood, and agree to the following Terms & Conditions.

ASSUMPTION OF RISK, MEDICAL &
COMMUNICABLE ILLNESS ACKNOWLEDGMENT

Participation in physical training and athletic activities involves inherent risks, including but not limited to bodily injury, illness, permanent disability, or death. Participation is voluntary, and all risks are knowingly and willingly assumed.
You further acknowledge the risk of exposure to COVID-19 and other communicable diseases, which may result from participation in group training and use of shared facilities. By participating, you assume all risks related to exposure, illness, or transmission, regardless of whether such exposure occurs before, during, or after participation.
Participants and/or parents or guardians of minor athletes are encouraged to obtain medical clearance prior to participation. By participating, you represent and warrant that you and/or your athlete are physically able to participate and have no condition that would prevent safe participation.
Different Breed does not provide medical advice or diagnosis. Any dietary changes, supplementation, or fitness decisions are made at your own discretion and responsibility and should be discussed with a licensed healthcare provider.
Participants agree to immediately inform staff of any injury, illness, pain, distress, or medical concern before or during participation and understand they may stop or refuse any activity at any time.

EMERGENCY MEDICAL CARE & AUTHORIZATION

In the event of an emergency, Different Breed staff are authorized to call 911 and request emergency medical services (EMS). Participants and/or parents/guardians acknowledge and agree that:

Different Breed is not responsible for any medical expenses, ambulance fees, hospital charges, or related costs
If a parent or guardian cannot be reached, Different Breed staff may authorize and make medical decisions in coordination with EMS and medical professionals that they deem necessary for the athletes safety
Such decisions may be made without prior consent and without liability or repercussions to Different Breed, its staff, or representatives

PROPERTY COVERAGE & PREMISES

This waiver applies to all facilities, spaces, and property owned, leased, or operated by Outer Space Enterprises, including training areas, courts, turf, parking areas, entrances, and common spaces.

Different Breed is not responsible for lost, stolen, or damaged personal property, including vehicles or contents.

Participants are financially responsible for damage caused by themselves, their athlete, or their guests. Athletes are not permitted to wait outside the facility for pick-up for safety reasons.

SECURITY CAMERAS & RECORDINGS

Participants acknowledge that the premises are monitored by security cameras. Video and audio recordings may be used for safety, operational, insurance, and legal purposes, including investigations or legal proceedings.

MEDIA RELEASE

Participants grant Different Breed permission to use photographs, video recordings, and audio recordings for training, marketing, and social media purposes, without compensation.

ZERO-TOLERANCE POLICY

Different Breed enforces a zero-tolerance policy for:

Screaming, yelling, or disruptive behavior
Derogatory, disrespectful, or inappropriate remarks
Harassment, discrimination, or confrontational conduct

Violations may result in immediate removal, suspension, or termination of participation without refund.

PARENT / GUARDIAN CODE OF CONDUCT

Parents and guardians agree to:

Treat all staff, athletes, spectators, and families with respect
Address concerns directly with Different Breed staff
Refrain from coaching or shouting instructions
Exhibit sportsmanship, self-control, and positive role-model behavior

Noncompliance may result in removal from the premises or termination of the athletes participation.

ATHLETE CODE OF CONDUCT

Athletes agree to:

Be coachable and accept feedback
Arrive 10 minutes early to sessions
Communicate concerns directly with trainers
Give full mental and physical effort
Use respectful language and behavior at all times
Refrain from saying "I CANT"
Maintain a positive and growth-focused mindset
Leave the facility clean and orderly
Wear appropriate attire
Consume water only on courts or turf

BOOKING, ATTENDANCE & CANCELLATION POLICY

One account per family

Sessions may be booked up to 1 hour prior to start time

Cancellations for Group Sessions and Private Sessions require at least 6 hours notice and must be completed through the app

Cancellations for 1on1 Sessions and Shot Dr. Sessions require at least 12 hours notice and must be completed through the app

Verbal cancellations are not accepted

If you no-show for a scheduled session, that session will be forfeited, 1 additional credit will be deducted, and you may be removed from all future bookings.

Accidental bookings & double bookings will not be refunded.

Personal insurance is responsible for all injury-related medical costs

To ensure the best training environment for all athletes, participants must attend the appropriate skill-level session. Athletes registered for an incorrect session may be removed without refund.

POSTING & SOLICITATION POLICY

Posting or distributing petitions, notices, flyers, or materials on or near the facility is prohibited without prior written approval from management.

Refund Policy

All sales are final. Different Breed Performance Training, LLC does not offer refunds for any services, memberships, training packages, sessions, events, or digital products once purchased. This includes, but is not limited to: -Missed or unused training sessions -Memberships or packages not fully utilized -Cancellations due to scheduling conflicts, illness, travel, or personal circumstances -Early termination of memberships or programs -Purchases are non-transferable and non-refundable. By completing a purchase, the client acknowledges and agrees to this policy.

Different Breed Performance Training, LLC reserves the right, at its sole discretion, to offer credits or rescheduling options in limited circumstances. Any such accommodations do not constitute a waiver of this policy.

Membership Cancellation Policy

Memberships require a minimum commitment of 3 months before they are eligible for cancellation.
Memberships automatically renew and will continue from billing cycle to billing cycle until a cancellation request is submitted and processed.
After completing the 3-month minimum commitment, members must send a cancellation request through the app.
Cancellation requests must be submitted at least 3 business days before your next billing date to prevent the next recurring payment.
Cancellation requests submitted by phone, text message, email, social media, or in person will not be accepted.
If a cancellation request is not received, the membership will automatically renew, and the recurring payment will be processed on the next billing date.
Requests received less than 3 business days before the next billing date may result in the next payment being processed. That payment is non-refundable, and the membership will remain active through the end of that billing period.
Memberships remain active until the end of the current paid billing cycle.
Payments already processed are non-refundable.
Unused credits, missed sessions, and remaining membership benefits are not eligible for refunds or credits.
Different Breed Performance Training reserves the right to update membership policies with advance notice.

AGREEMENT

By booking, attending, or participating in any activity with Different Breed Performance Training, LLC, you acknowledge that you have read, understood, and voluntarily agree to these Terms & Conditions.
